Hit-and-run drink-driver who ended cyclists' paralympic dream receives 18 month sentence (17/8/11)

A hit-and-run drink-driver who ended a medal-winning disabled cyclist’s Paralympic dream has received an 18 month custodial sentence.

CTC's view:

The Judge’s remarks show that he clearly recognised the seriousness of Adams’s offence, and it reassuring that he chose to impose a relatively long driving ban.

The 18 month custodial sentence is based on a current maximum of just 2 years for ‘dangerous’ driving if the victim happens not to die – even though it is 14 years if the victim is killed. Recent legislation means that, in future, those who drive dangerously causing serious injury (but not death) will face a 5 year maximum – however this still only brings it into line with the maximum for causing death by careless (i.e. less bad) driving. This new maximum cannot apply in this case, as the offence predates the new legislation.
